1. Introduction

Welcome to Flowter ("we", "our", or "us"). By accessing or using our website (getflowter.com), web application, and Chrome extension (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the Service.

2. Acceptance of Terms

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.

3. User Accounts

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable any user account if, in our opinion, you have violated any provision of these Terms.

4. Service Description

Flowter is a tool that allows users to capture, document, and analyze user flows on websites. The Service includes:

  • A web application for viewing and analyzing captured flows
  • A Chrome extension for capturing website interactions
  • AI-powered analysis of user flows
  • Storage of captured screenshots and flow data

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Service.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Capture or analyze flows on websites where you do not have permission to do so, especially those containing sensitive personal information
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Harass, abuse, or harm another person
  • Submit false or misleading information
  • Upload or transmit viruses or malicious code

6. Subscription and Billing

Certain features of the Service require payment. By subscribing to a paid plan or purchasing credits, you agree to pay all fees in accordance with the pricing and payment terms presented to you.

Payments are processed through our third-party payment processor, Stripe. By providing your payment information, you authorize us to charge your payment method for all fees incurred.

All purchases are final and non-refundable, except at our sole discretion or as required by applicable law. Credits expire 12 months after purchase unless otherwise specified.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Flowter and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

You retain all rights to the content you upload, submit, or create through the Service. By uploading or submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Service to you.

8. Data Privacy

Our Privacy Policy, available at getflowter.com/privacy, describes how we collect, use, and share information about you when you use our Service. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall Flowter, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid us, if any, during the past twelve (12) months.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Flowter expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
